PokerPath Terms of Service

PokerPath is operated by PokerPath LLC, owned by James Shouey.
1. Acceptance of Terms
By creating an account, signing in, or otherwise using the PokerPath service (the “Service”) at https://pokerpath.app and any associated subdomains, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
You accept these Terms by (a) clicking “I agree” or similar affirmative consent during account creation, or (b) continuing to access or use the Service after these Terms are made available. For features that require an account, an affirmative checkbox acceptance is required and is logged with timestamp and Terms version at the time of acceptance.
Continued use constitutes ongoing acceptance. If we update these Terms, continued use of the Service after the effective date of the update constitutes acceptance.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
Minimum age: 18 years old. The Service is intended for adults only.
21+ for jurisdictions requiring 21+ for poker tournament participation. Many venues listed on the Service require players to be 21 or older. You are solely responsible for verifying and complying with the minimum age requirements at any venue you attend. PokerPath does not enforce age requirements at venues, does not collect proof of age, and does not represent that any specific tournament has confirmed your age eligibility.
No prohibited jurisdictions. You may not use the Service if you are in a jurisdiction where access to a poker-tournament discovery service is prohibited by law. PokerPath is a software service — it is NOT a gambling site, does NOT facilitate wagering, and does NOT handle gambling money — but you are responsible for ensuring your use complies with local law.
Legal capacity. You represent that you have the legal capacity to enter into these Terms.
3. Account Responsibility
3.1 One Account Per Person
Each individual may maintain only one PokerPath account. Creating multiple accounts to circumvent rate limits, evade a suspension, abuse the partner system, or for any other reason is prohibited and may result in suspension or termination of all associated accounts.
3.2 Accuracy of Information
You agree that the information you provide is accurate, current, and complete. You agree to update your profile promptly when it changes, particularly your email address.
3.3 Security of Credentials
You are responsible for safeguarding your password (or, if you use Google Sign-In, your Google account credentials). You agree:
- Not to share your password with anyone.
- Not to permit anyone else to use your account.
- To notify PokerPath promptly at support@pokerpath.app if you suspect unauthorized access.
PokerPath is not liable for any loss or damage arising from your failure to safeguard your credentials.
3.4 No Account Transfers
Accounts are personal. You may not sell, transfer, or assign your PokerPath account.
4. Acceptable Use
4.1 Permitted Use
You may use the Service to browse tournament listings, save tournaments, receive notifications you’ve opted into, use Player Plus features if you are a Plus subscriber, and access the partner dashboard if you are a verified partner.
4.2 Prohibited Conduct
You agree NOT to:
- Automate access beyond reasonable user-driven activity. This includes scraping tournament listings, scripted account creation, automated saving or unsaving of tournaments, and scripted querying of any non-public endpoint. PokerPath does not publish a public API; any automated access to non-public surfaces is prohibited.
- Create fake or impersonator accounts — accounts that misrepresent your identity, impersonate another person or organization, or evade prior bans or suspensions.
- Abuse the partner system — submit partner applications you know are inaccurate, claim casinos you are not authorized to claim, attempt to view another partner’s data, or otherwise circumvent the partner authority structure.
- Interfere with the Service — overload, disrupt, or attack the Service; bypass rate limits, security headers, or authentication; inject malicious content; exploit vulnerabilities.
- Misuse user-generated content — post abusive, harassing, defamatory, or otherwise unlawful content. PokerPath reserves the right to remove such content and suspend the account.
- Violate intellectual property rights — copy, reproduce, distribute, or create derivative works of any content on the Service without authorization, except as permitted by these Terms and applicable law.
- Use the Service for illegal purposes — including illegal gambling, money laundering, or any other unlawful activity.
4.3 Consequences of Violation
PokerPath may, in its discretion: warn you, suspend access to specific features, suspend or terminate your account, retain or delete content, and pursue any other remedy available under law.
4.4 Reporting Violations
If you become aware of conduct on the Service that violates these Terms, you may report it to support@pokerpath.app.
5. User-Generated Content
5.1 Content You Own
You retain ownership of content you submit to the Service: saved-tournament records, notification preferences, bankroll-tool data (if a Player Plus subscriber), travel-trip data, coaching session data, and any text notes you add.
5.2 License to PokerPath
When you submit content, you grant PokerPath a limited, non-exclusive, royalty-free license to:
- Store, display, and process your content to operate the Service for you.
- Make backup copies as part of disaster-recovery practices.
- Use aggregate, anonymized counts of your activity (containing no per-user identity) for service-improvement purposes.
This license terminates when you delete the content (or your account), except for backup copies that may persist for up to 30 days.
5.3 No Public Posting
The Service does not currently provide a public posting mechanism. Your content is private to your account and to PokerPath as operator.
5.4 Content Removal
You may delete your content at any time using the relevant interface. When you delete, PokerPath stops using it to operate the Service. Backup copies roll off within 30 days.
6. Subscription and Paid Tiers
6.1 Player Plus Subscription (Future)
A Player Plus subscription tier is planned for a future release. When it launches:
- Subscription mechanism: Stripe. Stripe handles all payment processing; PokerPath never sees or stores your card data.
- Billing cycle: monthly (auto-renewing unless canceled).
- Cancellation: you may cancel at any time via your account settings; access continues through the end of the current billing period.
- Refunds: PokerPath does not offer prorated refunds for mid-cycle cancellation. Full-period refunds are at PokerPath’s discretion for legitimate billing errors.
- Price changes: existing subscribers receive at least 30 days’ notice before any price change takes effect.
6.2 Partner Tier (Future)
A Partner tier (for verified casinos and tournament operators) is in development. Partners are verified through an application + admin-approval flow. Verified partners may access aggregate reporting on user interest in their tournaments; partners do NOT access individual user identities under any circumstance. A separate Partner Agreement governs partner-specific rights and responsibilities.
6.3 Free Tier
The free tier remains available indefinitely.
7. Third-Party Content Disclaimer
Tournament information displayed on PokerPath is aggregated from public sources including casino-published schedules, CardPlayer.com, PokerAtlas.com, and PokerNews.com. PokerPath compiles factual information (dates, times, buy-ins, venues) that is not subject to copyright protection. PokerPath does not republish proprietary content, descriptions, or editorial material from these sources. Users should verify all tournament details directly with the operating casino.
Tournament dates, buy-ins, structures, and other details may change between PokerPath’s data sourcing and the actual event. Tournaments may be canceled, postponed, or modified by the host venue without notice to PokerPath. PokerPath has no control over the third-party source’s accuracy.
8. Tournament Information — Reliance Disclaimer
You agree not to rely solely on PokerPath for tournament scheduling, travel, lodging, financial, or other decisions. Always verify tournament details, dates, buy-ins, and structure directly with the casino before traveling or making financial commitments. PokerPath is a discovery and planning tool, not a tournament operator. PokerPath does not handle money, register entrants, or guarantee tournament occurrence.
PokerPath has no contractual relationship with the host venues (other than future Partner-tier relationships governed separately) and assumes no responsibility for the conduct, operation, or outcome of any tournament.
9. No Professional Advice
PokerPath does not provide legal, financial, tax, gambling, investment, or travel advice. Information provided through the Service is for general informational purposes only. Consult appropriate professionals for advice specific to your situation.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POKERPATH DISCLAIMS ALL WARRANTIES, INCLUDING (BUT NOT LIMITED TO):
- Merchantability
- Fitness for a particular purpose
- Non-infringement (beyond what applicable law mandates)
- Accuracy of tournament data, partner data, or any other information presented
- Uninterrupted operation — PokerPath operates on a best-effort basis without committed uptime SLAs
- Security — while we take reasonable measures, no system is perfectly secure
You use the Service at your own risk. Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, some exclusions may not apply to you and you may have additional rights.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKERPATH’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO POKERPATH IN THE PRIOR 12 MONTHS. FOR USERS WHO HAVE NOT PAID POKERPATH ANYTHING, TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD).
11.1 No Liability for Indirect Damages
POKERPATH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — including loss of profits, loss of revenue, loss of data, loss of business opportunity, or loss of goodwill — arising out of or related to your use of the Service, EVEN IF POKERPATH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 No Liability for Tournament Outcomes
PokerPath has no liability for tournament results, prize-pool distributions, gambling outcomes, losses incurred by traveling to a tournament that was canceled or different from what PokerPath listed, disputes between you and the host venue, disputes between you and other tournament participants, or third-party content.
11.3 No Liability for User-Generated Content
PokerPath has no liability for content you submit or for any reliance you place on content others submit.
11.4 Statutory Carve-Outs
Nothing in this section limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless PokerPath, its officers, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service in violation of these Terms.
- Your violation of any applicable law (including gambling-related law in your jurisdiction).
- Your violation of any third-party right (including intellectual property rights and privacy rights of other users).
- Any content you submit to the Service, including notes, descriptions, or any text-field content.
- Your interactions with host venues, other users, or any third party in connection with information you obtained through the Service.
- Misuse of the Service, including but not limited to:
- Automated scraping or programmatic access of non-public surfaces.
- Creating fake accounts or impersonator accounts.
- Submitting fake or unauthorized partner claims.
- Using the Service in connection with illegal gambling, money laundering, or other unlawful activity.
- Copyright complaints arising from content you submitted.
The obligations in this section survive termination of your account or the Service.
PokerPath reserves the right (but has no obligation) to assume the exclusive defense and control of any matter for which you have agreed to indemnify PokerPath, in which case you agree to cooperate with PokerPath’s defense.
13. Force Majeure
PokerPath shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including (but not limited to): acts of God, natural disasters, fires, floods, earthquakes, pandemics, epidemics, civil unrest, war or armed conflict, terrorism, governmental actions or restrictions, labor disputes, internet or telecommunications failures, hosting-provider outages, third-party service-provider outages, power failures, denial-of-service attacks, or any other cause beyond PokerPath’s reasonable control.
Performance obligations are suspended for the duration of the force majeure event. If the event continues for more than 30 days, either party may terminate by written notice.
14. Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
14.1 Binding Arbitration
Except for matters explicitly carved out below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
14.2 Class Action Waiver
YOU AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. No arbitration shall be consolidated with any other arbitration without the express written consent of all parties.
14.3 Jury Trial Waiver
YOU WAIVE ANY RIGHT TO A TRIAL BY JURY in any proceeding arising out of or related to these Terms or the Service, to the maximum extent permitted by law.
14.4 Venue and Governing Law
The arbitration shall take place in Texas (or by remote/virtual hearing at the arbitrator’s discretion). These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
14.5 Carve-Outs
The following matters are NOT subject to arbitration:
- Small claims court — either party may bring an individual action in small claims court for claims within that court’s jurisdiction.
- Injunctive relief — either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent ongoing harm.
14.6 30-Day Opt-Out
You may opt out of this arbitration and class action waiver by sending written notice to support@pokerpath.app within 30 days of your account creation. Your notice must include your account email address and a clear statement that you opt out of the arbitration agreement. Opting out does not affect any other provision of these Terms.
14.7 Severability of Class Action Waiver
If the class action waiver is found unenforceable in any context, then the entire arbitration agreement shall be void for that dispute, but the rest of these Terms remain in effect.
15. Termination
15.1 Your Right to Terminate
You may terminate your account at any time by using the account-deletion mechanism in your settings or emailing support@pokerpath.app. Upon termination, your data is deleted per the Privacy Policy retention schedule.
15.2 PokerPath’s Right to Terminate
PokerPath may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, fraudulent or abusive conduct, inactivity exceeding 24 months, requirement by law, or operational decision.
15.3 Effect of Termination
Upon termination, your right to access the Service ends and your account data is deleted per the Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 10, 11, 12, 13, 14, 16, 17, 18, 19, and 20) survive.
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. See Section 14.4 for arbitration venue.
If applicable law (including consumer-protection law in your state or country) provides rights that conflict with or supplement these Terms, those rights prevail to the extent of the conflict.
Use of the Service from any jurisdiction where the Service is prohibited by law is unauthorized.
17. Changes to These Terms
We may update these Terms from time to time. When we do:
- Update the “Last Updated” date at the top of these Terms.
- Provide notice of material changes — for signed-in users, via email to the address on file, at least 30 days before the change takes effect (unless required for legal or security reasons).
- Post the updated Terms on the Service before the change takes effect.
Continued use of the Service after the effective date of an update constitutes your acceptance of the updated Terms. If you do not agree with updated Terms, you must stop using the Service before the effective date (and may terminate your account per Section 15.1).
18. Responsible Gaming
PokerPath promotes responsible gaming. Poker tournament participation involves risk of financial loss. You are responsible for managing your bankroll, time, and play within your means. Gambling laws vary by jurisdiction; you are responsible for verifying the legality of poker tournament participation in your location before traveling or registering. PokerPath does not handle wagers, accept entries, or facilitate gambling transactions. If you or someone you know has a gambling problem, resources are available: National Council on Problem Gambling helpline 1-800-522-4700 (https://www.ncpgambling.org).

20. Severability
If any provision of these Terms is found by a court of competent jurisdiction (or arbitrator) to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, enforceable provision that most closely matches the intent of the original.
